Terms & Conditions
The terms that apply when you use this website and when you ask us to arrange a funeral.
Last updated
These terms apply to your use of this website and to the funeral services we provide. Please read them. If there is anything here you are unsure about, call us and ask — we would rather explain it than have you agree to something you did not follow.
Nothing in these terms takes away rights you have under the Australian Consumer Law. See Our responsibility to you below.
Using this website
You may use this website to find information about our services and to contact us. You must not use it in a way that is unlawful, or that interferes with the site or with anyone else’s use of it.
The content on this site — text, images, logos and design — belongs to us or is used with permission. You are welcome to read it, print it and share links to it. Please do not reproduce it commercially without our written permission.
Where we link to another organisation’s website, we do so for convenience. We do not control those sites and are not responsible for their content.
Information and pricing on this site
We try hard to keep this website accurate and up to date, and the prices shown are the prices we intend to charge.
However:
- Prices shown are starting prices. What you actually pay depends on the service you choose and where it takes place.
- Prices may change. The price that applies to you is the one in the written quote we give you, not the one on a page you looked at earlier.
- Some costs are set by other organisations, not by us. Cemetery and crematorium fees, doctors’ certificates, death notices, celebrants and catering are examples. We show these separately in your quote so you can see what is ours and what is not. We pass them on at cost and we cannot control what those organisations charge.
- General information on this site about funerals, cremation, burial or the law is provided to help you understand your options. It is not legal advice, and requirements differ between states and territories.
Quotes
A quote sets out what we will do and what it will cost. Unless it says otherwise, a quote is valid for 30 days.
A quote is not a contract on its own. An agreement is formed when you accept the quote and we confirm that we are proceeding.
If you ask us to change the arrangements after you have accepted a quote, or if something outside our control changes what is required, we will tell you what effect that has on the price before we act on it wherever it is practicable to do so.
Your authority to instruct us
Funerals can only be arranged by someone entitled to do so. By instructing us, you confirm that you are the executor of the estate, the senior next of kin, or otherwise legally entitled to authorise the funeral and to give us the instructions you are giving.
You also agree to tell us if you become aware of a dispute within the family, or of anyone else claiming that right. If there is a dispute about who may authorise the funeral, we may need to pause arrangements until it is resolved.
If you instruct us on behalf of an estate, you remain personally responsible for paying our account unless we have agreed otherwise in writing.
Payment
Payment terms are set out in your quote and invoice. Some third-party costs must be paid before the funeral can proceed, because the organisations charging them require payment in advance.
If you are expecting to pay from the estate, from a funeral bond or insurance policy, or through a government assistance scheme, tell us early so we can work out the timing with you.
Changes and cancellation
You may change or cancel arrangements by telling us as soon as possible.
If you cancel, we will charge you for work we have already done and for any third-party costs we have already committed to on your behalf that cannot be recovered. We will explain any such amount to you.
Very occasionally something outside anyone’s control — weather, a coronial requirement, a crematorium or cemetery closure, illness — means arrangements have to change. If that happens we will contact you as soon as we can and agree an alternative with you.
Our responsibility to you
We will provide our services with due care and skill, and we take our responsibilities to your family seriously.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
Where we are permitted by law to limit our liability, and to the extent permitted, our liability for a failure to comply with a consumer guarantee is limited to resupplying the services, or paying the cost of having them resupplied.
We are not responsible for the acts or omissions of third parties you have asked us to engage on your behalf, beyond taking reasonable care in engaging them.
Privacy
We handle personal information in accordance with our Privacy Policy, which forms part of these terms.
Changes to these terms
We may update these terms from time to time. The version that applies to your arrangements is the one in force when your quote was accepted. The current version is always on this page, with the date it was last updated shown at the top.
Governing law
These terms are governed by the law of the Australian state or territory in which we provide the services to you, and the courts of that place, and the courts of the Commonwealth of Australia, have jurisdiction.
